Many employers have been dealing with increasing work loads by hiring what they believed were independent contractors, only to learn the hard and expensive way that those individuals must be treated as employees.  We will explain the intricacies of employees versus independent contractors and the taxation and administrative implications of each classification.  Topics to be covered include:

  • Maine’s ABC test for the determination for whether an individual is an employee or an independent contractor
  • Internal Revenue Code test
  • The significance of the determination for employment tax, unemployment benefits and workers’ compensation purposes
  • Strategies for handling state and federal review of employment status
